We are filing for bankruptcy and putting our house on it too to get out of this moldy old house that needs way more repairs than we can pay for. Maybe I won't be so ill when we move out.

We are managing to get under the Oct. 17 deadline when laws change and credit cards can't be put on a bankruptcy.

I'll be glad when it is all done. We have our second appointment with the lawyer Saturday and will pay him. Then it will get filed the first business day after that.

(hugs) I'm sorry so that you have to go through this, but I'm glad that you're getting in before Oct 17th. It sounds like you've thought through the whole thing and that this is the best option for you.

sorry you're having to do this, but sometimes it really is the best thing to do.

when did they decide to change the laws and say you can't put credit cards on a bankruptcy?
we went with a debt consolidation loan to get rid of ours, but i hadn't heard about this and was just curious.

It was fairly recent and goes into effect Oct. 17, 2005 so if you are wanting to do it, you must do it before that date. You only have to have it filed, not have the follow up court appearance to settled it. Just the official paperwork started.

PS. The cost was $454...a $209 court filing fee and $295 lawyer fee (less a $50 discount because my husband works for the city here and the lawyer used to be mayor or something of our town years ago and gives a discount to city employees).

You have to pay that amount before it can get taken care of so you have to have the cash.

Well, we got the papers in the mail today giving us our court date which is November 7, 2005. It was officially filed yesterday 9-19, but still under the deadline of 10-17-05 for that credit card ruling thing. I'll have to get my papers together before then, but that is no big issue.

We are trying to save up our money now that we don't have house payments or insurance to pay so we can rent somewhere else.

HUGS Debbie. We just filed as well. We have a first and second on our home so we we able to file chapter 7 and still keep our house and our vehicles (which are old and not worth much). It stinks, but it is actually a relief to have a fresh start. We could have never dug our way out any other way.
